private postsecondary institutions in this state shall not adopt sanctuary policies; to provide for penalties for violations; to provide for related matters; to repeal conflicting laws; and for other purposes.
Although there is no indication on who will be responsible for administering House Bill 37, it is likely that the State of Georgia Non-Public Post-secondary Education Commission along with the Georgia Student Finance Authority will be responsible for administering this bill. It is likely that they will also work with the Department of U.S. Citizenship and Immigration Services and law enforcement.
HB 37 will not be proving program and services, but will severely limit the ability for DACA students to receive a post-secondary education without fear of deportation of themselves and their families. Private post-secondary institutions will also increase their fear of losing state and federal funding breaking anti-sanctuary school policies. There is no fiscal note accompanying this bill and it is unclear how much money HB 37 will take to crat a task force to ensure private post-secondary institutions are following the law.
